The Supreme Court deemed the right of drug testing to all schools around the nation. Some have refused this privilege and have not begun to test their students. If a student is in extra curricular actives they are liable for a drug test, random yes, but mandatory for them to perform the task. If the student is found to be intoxicated they will not be able to participate in any of the schools activities, and in some cases they have been expelled from school.
Many schools support this law, and practice their right often. The parents of the children in some places support this act, and encourage it to continue, and the drug testing is for the students benefit. It protects them in the young stages of life. These random tests help people find how best to help the student, and to fix, or eliminate the problem. Between a new born and a full grown adult the mind is always growing and expanding. If drugs are used in adolescence, this delicate growth ends, or becomes very slow. If this were to happen the mind would never fully reach its potential.
Although this is for the students benefit there are those would believe that it violates a students rights given to them in the fourth Amendment.
In California as right now they practice the right to have random drug testing, but that might come to a halt. Many students and parents have been petitioning this law, and have formed a bill SB 1386 to ban the drug testing. If governor Arnold Schwarzenegger signs this bill all drug testing of students will be banned in California. A high school student, Lindsey Earls from Oklahoma states that drug testing is humiliating and violates her right to privacy (Lehrer, Jim. Courts Alter Student Rights. July 3, 2002.). Many people do not support this law and would like to see it vanish. Some have even petitioned the president to ban this law. Others believe that this law violates their privacy, rights, and stops them living the life they want.
In conclusion many people believe this to be a good thing, and others, an irritable one. The law passed is a law we must obey. If one has nothing to hide, then don't. This law was passed to help students around the nation to get the instant help that they need to stop a deadly habit.
